These Terms and Conditions ("Terms") govern your use of notizy.id and the Notizy platform (the "Service"), operated by PT Noxy Digital Solution ("Notizy", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account and workspace.

2. The Service

Notizy provides tools to manage WhatsApp Business messaging through the Meta WhatsApp Business Platform, including inbox, broadcasts, templates, and AI-powered replies. Features may change over time. We do not guarantee uninterrupted or error-free operation, and parts of the Service depend on third parties such as Meta.

3. WhatsApp and Meta Policies

You must comply with the WhatsApp Business Policy, the WhatsApp Commerce Policy, and Meta's terms. Meta may restrict or ban your number or account at its discretion; Notizy is not responsible for such actions. Messaging fees charged by Meta may apply in addition to your Notizy plan.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam or messages to people who have not opted in.
  • Send unlawful, fraudulent, harassing, or misleading content, or infringe others' rights.
  • Distribute malware or attempt to breach our security.
  • Resell, reverse engineer, or overload the Service without our permission.

5. AI Features

AI-generated responses may be inaccurate or incomplete. You are responsible for configuring, reviewing, and supervising AI features and for the messages sent to your customers.

6. Plans, Trials, and Payment

  • Paid plans are billed in advance on a monthly or yearly basis at the prices shown at checkout.
  • The free trial is available once per account or organization.
  • Unpaid invoices expire; features may be limited or suspended if your plan lapses or exceeds its limits.
  • Except where required by law, payments are non-refundable.
  • We may change prices with prior notice.

7. Your Content

You retain ownership of the content and data you upload or send through the Service. You grant us a limited license to process it solely to operate and improve the Service. Our handling of personal data is described in our Privacy Policy.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by PT Noxy Digital Solution. These Terms do not grant you any rights to our intellectual property other than to use the Service.

9. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or if required by law or by Meta. Upon termination, your right to use the Service ends.

10. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Notizy is not liable for indirect, incidental, or consequential damages, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

11. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Disputes will first be resolved amicably; if not resolved, they will be submitted to the competent courts in Indonesia.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
